Today, we’re beginning our review of the individual Justices’ voting records in civil constitutional law cases.
Justice Garman has participated in 84 civil constitutional law cases during her tenure, voting for the defendant, at least in part, in 51 cases and for the plaintiff 33 times. She supported defendants in 10 of 12 cases in 2005 and 2006 and in all nine cases from 2010 to 2012. Since 2013, she has voted for defendants in 15 cases while voting for plaintiffs in 16.
Justice Garman has participated in 45 constitutional law cases won by the defendant below, voting to affirm 28 times and to reverse, at least in part, in 17 cases. Justice Garman evenly split her votes in ten cases between 2001 and 2004. She then voted to affirm in all eight defense wins in 2005 and 2006. She voted to affirm all ten defense wins from the Appellate Court between 2010 and 2014. Justice Garman has voted to reverse, at least in part, in seven of nine defense wins from the Appellate Court since 2015.
Justice Garman has voted to reverse at least in part in 23 of 39 civil constitutional law cases since 2001. She voted to reverse in four of five cases between 2001 and 2003. Between 2004 and 2007, she voted to reverse in four of ten cases. Between 2008 and 2012, she voted to reverse, in whole or in part, all seven defense losses from the Appellate Court. Since that time, she has voted to reverse in eight of 17 cases.
