Since taking his seat on the Court, Justice Thomas has participated in 229 criminal constitutional law cases.  He has voted for defendants in 54 cases and against them in 175 cases.  Between 2001 and 2009, Justice Thomas supported defendants in only 31 cases and against them in 106 cases.  Between 2010 and 2019, Justice Thomas supported defendants in 23 cases and voted against them in 69 cases.

Justice Thomas has participated in 146 criminal constitutional law cases won by the defendants below.  He voted to affirm in 34 cases and to reverse 112 times.  From 2001 to 2009, Justice Thomas voted to affirm in 23 cases and to reverse 71 times in criminal constitutional law cases won by defendants below.

 

Justice Thomas has participated in 83 criminal constitutional law cases lost by the defendants below.  Justice Thomas voted to reverse in 20 of those cases and voted to affirm in 63 cases.  Between 2001 and 2009, Justice Thomas voted to reverse in eight cases and voted to reverse 35 times.  Between 2010 and 2019, Justice Thomas voted to reverse in 12 cases and voted to affirm 28 times.
